Petition to the Minister of Immigration and Citizenship

The Honorable Jason Kenney

We ask the Honorable Minister to address the issue of abuse in the immigration system with specific reference to marriage fraud where foreign nationals deliberately mislead and misrepresent themselves to gain landed immigration status in Canada.

The Problem:

Canadian Citizens are the target of a massive and seemingly coordinated attack on their status as foreign spouses pretend to be honest in their marriage intentions only to expose their false intentions on arrival in Canada. The Immigration act and the actual permanent residence applications and its declarations, the criminal code on misrepresentation and the Charter of Rights and Freedom all combine to give protection to Canadians against this fraud. This fraud has now assumed cancerous proportion and society as a whole can no longer afford or tolerate it.

Therefore, this petition calls on the honorable minister To:

• Take seriously the complaints of Canadians for an investigation into this matter, to have then reviewed in the light of the country’s laws and to apply the existing laws with prompt and to have all those foreign spouses who came to Canada by deception and misrepresentation, deported. This is equity that is putting both parties back to their very positions before the fraud was committed so that no one has a fraudulent advantage of any kind.
• Amend the IRPA so that every spouse must demonstrate 3 years co-habitation upon arrival in Canada, before they are granted a Landed Immigrant Status.
• To address the question of abuse to these foreign spouses, a panel be set up to prove the abuse.
